Where the individual pays for a service, credit card information may be provided to a third-party payment provider.

The services provided by ICANS collect only the information necessary to allow users to access and register for its services via ICANS websites. These services enable individual users and any advisers who participate to access the Smartsettle collaboration or online dispute resolution process. This process, that ends in a formal settlement document, requires that the parties identify themselves. Parties are asked only for their legal name, address, email, and telephone number.
When you send us electronic mail, we collect your email address and your message so that we may reply to you. We recommend that sensitive personal information not be sent unencrypted over the Internet or by email.
ICANS utilizes Twitter, Facebook, YouTube, and other public, third-party social media providers. Personal information that you might provide to social media is not hosted on our server. We recommend that our followers using social media familiarize themselves with the social media provider’s terms of service and privacy policies.
ICANS uses a third-party service to analyze non-identifiable web traffic data with the purpose of improving the services we offer. ICANS owns and stores the data that is generated on its secure web server. The collected data will not be shared with any other party for any other purpose.
ICANS may collect the following information to assist us with improving the website:
- The pages accessed on our site and links you clicked on
- The date and time you visited the site
- If you use our advanced search tool, the search terms you used
- The referring site (if any) through which you arrived at this site
- Your operating system (e.g., Windows XP, Mac OS X)

IP addresses are anonymized so that they cannot be used to identify individuals. Our web analytics will also respect any “do not track” setting that you might have set on your browser.

If a facilitator is involved in the negotiation, privacy of the information to which the facilitator is given access, is governed by a separate agreement signed prior to beginning the process. The recommended form to be used by Smartsettle facilitators is available upon request.
As part of using ICANS services, there may be online communications between you and the party with whom you are negotiating. These online communications are not reviewed by ICANS or any of its employees, agents or representatives, and this information is not retained by ICANS outside of your case. It is your choice to disclose information to the other party. Private Information entered into the system during negotiation is always under the control of the user and is accessible only by those to whom the user gives the access codes. Users can change or remove their private party information at any time. Except as otherwise decided by the negotiating parties, all decisions reached with Smartsettle will be kept confidential.
